Waiver:

INDEMNITY AND CONTRACT AGREEMENT:

In consideration for me or my child’s attendance and participation in the martial arts training offered by Red Fox Brazilian Jiu-Jitsu, Incorporated, I, (print full name) , acknowledge the existence of certain inherent risks in this type of training. I will not hold or attempt to hold Red Fox Brazilian Jiu-Jitsu, Inc., associated Instructors and Staff liable for any loss, damage, or injury to person or property caused by any act or neglect of other persons, or caused in any manner other than the willful or negligent act of Red Fox Brazilian Jiu-Jitsu, Inc., associated Instructors and Staff, its agents and employees, and will indemnify and hold Red Fox Brazilian Jiu-Jitsu, Inc., associated Instructors and Staff harmless from any liability for damages or claims against Red Fox Brazilian Jiu-Jitsu, Inc., associated Instructors and Staff arising out of or in any way related to any such loss, damage or injury. I release Red Fox Brazilian Jiu-Jitsu, Inc., associated Instructors and Staff, including its trustees, employees, and agents, from me or my child’s physical injury, including death, or illness while at the activity. I/We will assume the risk associated therewith, whether known or unknown to me/us at this time. This release is also intended to include all claims of my family, estate, heirs, personal representatives, or assigns.

INFECTIOUS DISEASE RISK ACKNOWLEDGEMENT AND AGREEMENT:

I acknowledge the contagious nature of infectious diseases to include the Coronavirus/COVID-19.  I further acknowledge that Red Fox Brazilian Jiu-Jitsu, Inc., has put in place preventative measures to reduce the spread of infectious diseases and other contagious illnesses.

I further acknowledge that Red Fox Brazilian Jiu-Jitsu, Inc. cannot guarantee that I will not be exposed to an infectious disease or other contagious illness. I understand that the risk of becoming exposed and/or infected may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff and other members and their families/guest.

I voluntarily seek services provided by Red Fox Brazilian Jiu-Jitsu, Inc. and acknowledge that I must comply with all set procedures to reduce the spread of infectious diseases and/or contagious illnesses while attending classes.

I attest that:

• I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
• I do not knowingly have any active contagious disease that may infect others to include but not limited to the flu, common cold, contagious skin rash/infection, warts, herpes (cold sores), etc.
• I will wash or sanitize my hands before and after each class.
• I will have a clean body/uniform/gym attire for each class.
• I will honor all safety rules and etiquette of the academy.
• I will stay home if sick or have any known contagious condition until cleared by a medical doctor and/or fully recovered.
• I will report any illness to the staff of Red Fox Brazilian Jiu-Jitsu, Inc. and agree to allow notification to other members that I may have come into contact with.

I hereby release and agree to hold Red Fox Brazilian Jiu-Jitsu, Inc. harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the academy/studio, or that may otherwise arise in any way in connection with any services received from Red Fox Brazilian Jiu-Jitsu, Inc. I understand that this release discharges Red Fox Brazilian Jiu-Jitsu, Inc. from any liability or claim that I, my heirs, or any personal representatives may have against the academy/studio with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Red Fox Brazilian Jiu-Jitsu, Inc. This liability waiver and release extends to the academy/studio together with all owners, partners, employees, and subcontractors.

AUTHORIZATION FOR TREATMENT:

I/We hereby give permission to the medical personnel selected by Red Fox Brazilian Jiu-Jitsu, Inc. to secure and administer treatment and to maintain and/or release any medical records necessary for insurance purposes as outlined under the HIPAA regulation, and to provide or arrange necessary related transportation for the above-named person. I verify that I or child named above is in good health and capable of participating in strenuous activities and, when necessary, will tailor my/their activities to those within the bounds of my/their physical health. I recognize that any medical treatment that is provided to me (or my child) while attending activities at Red Fox Brazilian Jiu-Jitsu, Inc. will be paid for by my medical insurance company and guarantee payment for services not paid by insurance.

PHOTO AND VIDEO RELEASE:

I hereby grant Red Fox Brazilian Jiu-Jitsu, Inc., and associated Instructors and Staff permission to use, reproduce, and/or distribute photographs, films, video and sound recordings of me or my child without compensation or approval, for use in materials created for purposes of promoting the activities of Red Fox Brazilian Jiu-Jitsu, Inc., and associated Instructors and Staff, including the Internet.

PROPERTY DAMAGE / CLASS OVERAGE(S)

The signee agrees to pay for any property damage they/the child they are responsible may cause while attending classes at the academy.  This includes intention or accidental damage that may be caused by not following academy rules such as no metal/jewelry in training areas.  Signee also agrees to pay a $39.00 mat fee for any classes taken past agreed upon trial period.
